A trademark is a sign, design or expression which identifies the products or services of a particular source from those of others. The owner of a trademark can be an individual, a company or any legal entity.
A trademark includes any device, brand, label, name, signature, word, letter, number, shape of goods, packaging, color or combination of colors, smell, sound, movement or any combination thereof, which is able to distinguish goods and services of one business from those of others. The mark is graphically represented and must be applied to the goods or services for which it is registered.
Specialized trademark types include certification marks, collective marks and trademarks.
The system for international trademark registration is governed by two agreements, which Albania has ratified as a member state:
1. Madrid Agreement Concerning the International Registration of Trademarks
2. Protocol to the Madrid Agreement.
Albanian legislation governing the international registration of trademarks consists of:
1. Law no. 9947 dated 07.07.2008 “On industrial property”
2. VKM. 1706 dated 29.12.2008 “On the approval of the rules for trademark registration” Chapter XV and XVI.
